When investing in real estate-secured loans, one of the most important questions a private lender should ask is: “Where do I stand in line if something goes wrong?”

The answer depends on lien priority, which determines the order in which creditors are entitled to receive payment from a property's proceeds when competing claims exist.

A first-position mortgage generally has priority over subsequent mortgages. If the borrower defaults and the property is foreclosed upon, the first-position lender typically gets paid before junior lienholders.

A second-position mortgage, on the other hand, sits behind the first mortgage. While second-position loans often offer higher interest rates to compensate for additional risk, the lender must understand that the first mortgage takes priority.

Consider a property worth $250,000 with a first mortgage balance of $150,000 and a second mortgage of $40,000. On paper, there's $60,000 in remaining equity. That's a substantial cushion, but foreclosure costs, unpaid taxes, and declining property values could reduce it considerably.

This is why combined loan-to-value (CLTV) is so important. In our example, the combined debt represents 76% of the property's value, leaving a 24% equity cushion before expenses.

But lien priority isn't always as simple as first come, first served. Property taxes, certain statutory liens, and other legal claims may take precedence depending on applicable law.

Before funding any loan, private lenders should obtain a title search, verify existing balances, understand their intended lien position, and ensure their mortgage or deed of trust is properly recorded.

A lender's title insurance policy may provide additional protection against covered defects affecting lien priority.

The bottom line? Higher interest rates mean little if your collateral position is weak.

Successful private lending requires understanding not only the property's value but also exactly where your loan stands among competing claims.

Know your position. Understand your risk. Protect your capital.

What we’re up to…

Training, training, training! 📚🏡

One thing I've learned over the years is that to succeed in real estate investing, you can never stop learning!

This week, we've taken another exciting step in expanding our business by beginning our training in manufactured housing.

We've partnered with John Fedro of Mobile Home Formula to learn from his more than 20 years of experience investing in mobile and manufactured homes.

While this is a relatively new segment for us, we see tremendous potential—not only to create profitable investment opportunities, but also to help more families achieve the dream of affordable homeownership.

As always, our goal is to combine education, experience, and creative real estate strategies to build a sustainable business while making a positive difference in people's lives.

I'm excited about this new chapter and look forward to sharing what we learn along the way!
